Flynn's father, Jerome Flynn, filed a lawsuit alleging inhumane conditions and brutal assaults led to his son's death on December 2, 2023.
Government's Statement of Defence
In its statement of defence filed in Newfoundland and Labrador Supreme Court, the province acknowledges its responsibility for administering correctional services but denies that Flynn's death was a result of any action or inaction on their part. The government is seeking to have the claim dismissed and costs awarded to them. These claims have not yet been tested in court, and no dates have been set for a hearing.
Flynn's Background and Allegations
Seamus Flynn had a history of drug addiction and was incarcerated at HMP after pleading guilty to theft and weapons offences. His father described him as a "kind, gentle, and loving" person. The lawsuit contends that the province had a duty of care to protect Flynn from harm, cruel punishment, and to provide adequate medical care.
Events Leading to Flynn's Death
Cindy Flynn, Seamus's mother, stated that her son suffered from viral influenza, which progressed into a bacterial infection, severe pneumonia, and sepsis. Less than two weeks before his death, Flynn contacted CBC News alleging that he and other inmates had been beaten by prison guards in October, resulting in lost teeth and impaired vision and hearing. Inmates filed a complaint with the citizens' representative.
Investigation and Outcome
Following Flynn's death, the Royal Newfoundland Constabulary (RNC) launched an investigation in December 2023. Justice department officials told CBC News that HMP was locked down on October 11 due to a "disturbance" and that the "situation was handled appropriately." However, Jerome Flynn's lawsuit alleges "routine assaults and brutal conditions which made the facility uninhabitable." The RNC concluded its investigation more than six months later, with no charges laid.
Legal Proceedings
Jerome Flynn is seeking damages and costs, including funeral expenses, while the province requests the claim's dismissal and awarded costs. The case remains unresolved, and the allegations against the Newfoundland and Labrador government are yet to be proven in court.
